Individuals who wish to apply for TPS under the Ukraine or Sudan classification must submit an application Form I-821.
Secretary of Homeland Security Alejandro N. Mayorkas previously announced an 18-month TPS designation for both Ukraine and Sudan.
According to USCIS, 59,600 people currently living in the United States since April 11, 2022 may be eligible for TPS under Ukraine’s categorization. Ukrainian nationals who are currently outside the US are not eligible and will not become eligible in the coming weeks if they relocate to the US. Ukrainians are encouraged instead to seek for a visa or other legal pathway at a US consulate abroad.
Under the Sudan’s Eligibility Criteria: Sudan Nationals must show continuous residence in the United States since March 1, 2022, as well as continuous physical presence in the United States since the designation date in the Federal Register notice, to be eligible under the Sudan designation.
Under the Sudan designation, the USCIS estimates that 3,090 people may be eligible for Temporary Protected Status (TPS). This includes an estimated 2,390 newly qualified individuals and 700 current TPS Sudan beneficiaries. These individuals must file a new application for TPS under the new Sudan designation to avoid losing protection if the court injunctions are lifted.
Both Ukraine and Sudan Applicants can obtain an Employment Authorization Document while filing a TPS application by submitting a completed form I-765, Application for Employment Authorization, together with their Form I-821.
